Terms & Conditions
Last updated: September 22, 2026
These Terms & Conditions ("Terms") are an agreement between you and Marisol Garza, M.S., LPC-S ("we," "us," or "our"). They govern your use of marisolgarzalpcs.com (the "Website") and your purchase of and participation in any workshop, course, live call, recording, download, or other training we offer (each a "Program"). Please read them carefully. By using the Website, registering for a Program, or checking the box at checkout, you agree to these Terms, our Privacy Policy, and our Disclaimer. If you do not agree, please do not use the Website or purchase a Program.
1. Who our Programs are for
Our Programs are professional education for graduate-level counseling students, pre-licensed therapists, and licensed mental health professionals. You must be at least 18 years old to purchase or take part. By registering, you confirm that the information you give us is accurate and that you are purchasing for your own professional development.
2. Educational purpose only
Our Programs are educational. They are not therapy, counseling, clinical supervision, consultation on specific cases, or legal or ethics advice. Taking part does not create a therapist and client relationship or a supervisor and supervisee relationship between you and us. Time spent in a Program does not count as supervision hours toward licensure. You remain fully responsible for your own clinical decisions, for practicing within your scope, training, and licensure, and for following the laws, regulations, and ethics codes that apply to you. Please see our Disclaimer for more detail.
3. No continuing education credit
Unless a Program's sales page clearly states otherwise, our Programs are not approved for continuing education (CE) credit by any licensing board or professional association, and no CE certificate will be issued.
4. Registration, pricing, and payment
Prices, dates, and what each Program includes are listed on its sales page at the time you register. All prices are in U.S. dollars. Payments are processed by third-party payment processors through our checkout platform. We do not see or store your full card number.
Some Programs offer an early bird price or a payment plan. Early bird pricing is available only until the deadline shown on the sales page. If you choose a payment plan, you authorize us to charge your payment method automatically on each scheduled date until the plan is paid in full. Choosing a payment plan is a commitment to pay the full Program price. If a scheduled payment fails, we will contact you, and we may pause your access to the Program until the balance is paid.
Please contact us before filing a chargeback or payment dispute so we can try to resolve the issue. If you file a chargeback for a valid charge, we may end your access to all Programs.
5. Refunds and cancellations
Workshops. Workshop registrations, including Grief Starts Here, are non-refundable. Every registrant receives the replay, so you keep access to the content even if you cannot attend live.
Multi-week courses. For multi-week courses, including The Grief-Confident Therapist, you may request a full refund within 7 days after the course start date. For the cohort beginning January 9, 2027, the last day to request a refund is January 15, 2027. To request a refund, email connect@marisolgarzalpcs.com from the address you registered with. Approved refunds are returned to your original payment method, and any remaining payment plan charges are cancelled. After the refund window closes, no refunds are given, and payment plan balances remain due.
Changes by us. We may need to reschedule a live session because of illness, emergency, or technical problems. If that happens, we will let you know as soon as we can and provide a new date or a recording. If we cancel a Program entirely and do not reschedule it, you will receive a full refund of what you paid for that Program.
6. Access to Programs and recordings
Live sessions are held online through a video conferencing platform, and course materials are delivered through our online course platform. You are responsible for having a reliable internet connection and a device that can run these platforms.
Workshop registrants receive access to the workshop replay. Course participants receive lifetime access to the course materials and call recordings for as long as the course remains active. If we ever need to retire a course or move it to a new version, we will email participants in advance to explain what will happen to their access, including whether current participants will keep access to the version they purchased. We will give you at least 30 days' notice before any access ends so you can download materials offered for download.
Your access is personal to you. Please do not share your login, forward access links, or let others attend using your registration.
7. Live sessions, recording, and confidentiality
Live sessions may be recorded and shared with Program participants as replays. Recordings may include your name, voice, image, and anything you post in the chat. You may keep your camera off and change your display name if you prefer not to appear. By joining a live session, you consent to being recorded for this purpose. We will not use recordings that show you in public marketing without your separate written permission.
If you share a clinical example, you must remove all information that could identify a client, including names, dates, locations, and unique details. Do not share protected health information. Please treat anything other participants share about themselves or their work as confidential. You may not record, screenshot, or share live sessions or other participants' contributions.
8. Code of conduct
We want every Program to be a respectful learning space. We may remove you from a session, community space, or Program without a refund if you harass or disrespect other participants, share client information that could identify someone, promote your own products or services without permission, or otherwise disrupt the learning environment.
9. Intellectual property
All Program content, including the SHIFT Framework, videos, recordings, slides, workbooks, handouts, templates, and written materials, is owned by us and protected by copyright and other intellectual property laws. When you purchase a Program, we grant you a limited, personal, non-transferable license to use the materials for your own learning and in your own clinical work with your clients.
You may not copy, resell, share, publish, or distribute Program materials. You may not use them to teach, train, supervise, or present to others, or to create a competing course or product, without our written permission. Client-facing handouts that a Program marks as shareable may be given to your own clients.
10. Website use
You agree not to use the Website in any way that breaks the law, interferes with its operation, attempts to gain unauthorized access to any system, or collects information about other users. We may change, suspend, or discontinue any part of the Website at any time.
11. Testimonials and results
Testimonials on the Website reflect the experiences of individual participants. They are not a promise that you will achieve the same outcome. Your results depend on your own effort, experience, and circumstances.
12. Third-party services and links
We use third-party services to run the Website, process payments, send email, host courses, and hold live sessions. Your use of those services may also be governed by their own terms. The Website may link to other websites that we do not control, and we are not responsible for their content or practices.
13. No warranties
The Website and Programs are provided "as is" and "as available." To the fullest extent the law allows, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Website or any platform will be uninterrupted or error-free.
14. Limitation of liability
To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of income, clients, or data, arising from your use of the Website or any Program, or from how you apply what you learn in your professional work. Our total liability for any claim related to these Terms, the Website, or any Program will not exceed the amount you paid us for the Program involved in the claim.
15. Indemnification
You agree to hold us harmless from any claims, losses, or expenses, including reasonable attorney's fees, that arise from your breach of these Terms, your misuse of Program materials, or your clinical or professional work.
16. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law rules. If a dispute comes up, please contact us first so we can try to resolve it informally. If we cannot resolve it within 30 days, the dispute will be resolved in the state or federal courts located in Nueces County, Texas, and you agree to the jurisdiction of those courts.
17. Changes to these Terms
We may update these Terms from time to time. The date at the top of this page shows when they were last changed. Changes apply from that date forward and do not change the refund terms of a Program you already purchased.
18. General
If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any part of these Terms is not a waiver of our right to do so later. These Terms, together with our Privacy Policy, our Disclaimer, and the sales page of any Program you purchase, are the entire agreement between you and us about the Website and our Programs.
19. Contact
Questions about these Terms can be sent to connect@marisolgarzalpcs.com.
